AgentWake is operated by Benjamin Banwart ("we," "us," "our"). AgentWake is a digital product consisting of a markdown file ("the Product") that provides instructions for Claude Code to guide the buyer ("you," "your") through setting up an autonomous AI agent on their macOS machine. Claude Code automates what it can (installing software dependencies, building the knowledge base) and walks the buyer step by step through the parts that require human action (macOS system settings, Discord bot creation and configuration).
You must be at least 18 years of age to purchase and use the Product. By purchasing, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

By completing your purchase, you confirm that you have read and understood these Terms of Service, including the risks described in Section 3, and that you voluntarily accept those risks. This acknowledgment constitutes an active consent event and is a condition of your purchase.
The Product is provided "as-is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Product will be error-free, uninterrupted, or that it will meet your specific requirements. We do not warrant that the AI agent will behave as expected in all circumstances.
To the maximum extent permitted by applicable law, the seller shall not be liable for any:

You agree to defend, indemnify, and hold harmless AgentWake, its owner, and its affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including reasonable attorney's fees) arising from:
All intellectual property rights in the Product, including its structure, content, and design, are owned by AgentWake and are protected by applicable copyright and intellectual property laws. The Product is licensed, not sold.
Upon purchase, you are granted a single-user, non-transferable license to use the Product on your own machines. You may not:
You may modify the Product file for your own personal use. The brain files, configurations, and outputs generated by the Product on your machine are yours.
Filing a fraudulent chargeback or payment dispute after downloading the Product constitutes a violation of this license and will result in immediate termination of your license to use the Product.
Due to the digital nature of the Product, all sales are final. If you experience a technical issue that prevents you from using the Product, contact us at benji@agentwake.com within 7 business days of purchase and we will work to resolve it.
Nothing in this section is intended to limit any statutory refund rights you may have under mandatory consumer protection laws in your jurisdiction. Where such laws apply, they take precedence over this policy.
The Product relies on third-party services and software including but not limited to: Anthropic's Claude Code, Discord, Homebrew, and tmux. We are not affiliated with these services and are not responsible for changes to their availability, pricing, terms of service, or functionality that may affect the Product.
You are solely responsible for maintaining your Anthropic account in good standing and ensuring your use of the Product complies with Anthropic's Acceptable Use Policy and Terms of Service, as they exist at the time of your use. We make no guarantees that the Product's use case will remain permitted under Anthropic's terms, which may change at any time. If Anthropic restricts or prohibits autonomous agent use cases, we are not liable for any resulting loss of functionality.
We are not liable for any disruption, degradation, or loss of functionality caused by outages, changes, or discontinuation of any third-party service, including but not limited to Anthropic, Discord, and Apple (macOS). Such events are outside our control and do not constitute a defect in the Product.
You are solely responsible for:
These Terms shall be governed by and construed in accordance with the laws of the State of Kansas, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Product shall be resolved through binding arbitration administered in the State of Kansas, except that either party may bring individual claims in small claims court if the claims qualify. You agree to waive any right to a jury trial or to participate in a class action.
30-Day Opt-Out: You may opt out of the binding arbitration and class action waiver provisions by sending written notice to benji@agentwake.com within 30 days of your purchase date. Your notice must include your name, email address used at purchase, and a clear statement that you wish to opt out of arbitration. If you opt out, disputes will be resolved in the state or federal courts located in Kansas. Opting out does not affect any other provision of these Terms.
For buyers located outside the United States, the mandatory consumer protection laws of your jurisdiction apply to the extent they override any provision of these Terms. In such cases, the conflicting provision shall be modified to the minimum extent necessary to comply with applicable local law, and all other provisions shall remain in full effect.
We may update these terms from time to time. The terms in effect at the time of your purchase govern that purchase. If we make material changes that affect existing buyers, we will make reasonable efforts to notify affected customers via the email address used at purchase. We will update the "Last updated" date at the top of this page when changes are made.
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
These Terms of Service constitute the entire agreement between you and AgentWake regarding the Product and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written, including any statements made in marketing materials, support emails, or other communications.
