1. Who We Are

AgentWake is operated by Benjamin Banwart. For any privacy-related questions, contact us at benji@agentwake.com.

2. What We Collect

We collect minimal information necessary to process your purchase and deliver the Product:

• Email address — provided through the checkout process, used for purchase confirmation and product update notifications
• Payment information — processed entirely by Stripe. We do not store credit card numbers, bank account details, or other payment credentials on our systems. See Stripe's Privacy Policy for how they handle payment data.
• Purchase records — transaction date, amount, and product purchased, maintained through Stripe

3. What We Do NOT Collect

We want to be explicit about what we do not have access to:

• We have no access to your AI agent, its brain files, its conversations, or any data on your machine
• We do not collect analytics, usage data, or telemetry from the Product file
• We do not track how you use your agent or what it does
• The Product is a static markdown file — it does not phone home, send data to us, or connect to our servers

4. How We Use Your Information and Legal Basis

Your email address is used for:

• Sending your purchase confirmation and download link — Legal basis: contractual necessity (GDPR Article 6(1)(b)). Required to fulfill your purchase.
• Notifying you of product updates (new versions of the Product file) — Legal basis: legitimate interest (GDPR Article 6(1)(f)). You can unsubscribe from update emails at any time by contacting us or using the unsubscribe link included in each email.
• Responding to support requests — Legal basis: contractual necessity (GDPR Article 6(1)(b)).
• Communicating material changes to our Terms of Service — Legal basis: legitimate interest (GDPR Article 6(1)(f)).

We will not sell, rent, or share your email address with third parties for marketing purposes.

5. Third-Party Services

We use the following third-party services that may process your data:

• Stripe — payment processing. Stripe collects and processes payment information under their own privacy policy. See stripe.com/privacy.
• Cloudflare — website hosting and security. Cloudflare processes visitor data as described in their privacy policy, which may include IP addresses, browser characteristics, and security-related signals. See cloudflare.com/privacypolicy.

6. Data Retention

Purchase records are retained in Stripe for as long as necessary to comply with legal, tax, and regulatory reporting obligations. If you would like your email removed from our records, contact us at benji@agentwake.com. We will accommodate your request where possible; however, we may retain certain records where required for legal, tax, or regulatory compliance obligations, and will inform you of any such limitations when responding to your request.

7. Cookies and Do Not Track

The AgentWake website does not use cookies for tracking or advertising purposes. Cloudflare may set functional cookies necessary for security and performance. No third-party analytics or advertising cookies are used.

We do not track visitors across websites. We do not respond to "Do Not Track" browser signals because no tracking occurs on our site.

8. Your Rights

Depending on your jurisdiction, you may have the right to:

• Access the personal data we hold about you
• Request correction of inaccurate data
• Request deletion of your data
• Object to or restrict processing of your data
• Data portability

To exercise any of these rights, contact us at benji@agentwake.com. We will respond within 30 calendar days, which may be extended where permitted by applicable law.

9. International Transfers

Your data may be processed in the United States. Our third-party processors (Stripe, Cloudflare) maintain appropriate transfer mechanisms, including Standard Contractual Clauses, for international data transfers as required under applicable data protection laws. For transfers necessary to fulfill your purchase, we rely on contractual necessity under GDPR Article 49(1)(b).

10. Data Breach Notification

In the event of a data breach affecting your personal information, we will notify affected individuals in accordance with applicable law, including the Kansas data breach notification statute (K.S.A. 50-7a01), GDPR, and any other applicable regulations. Where required, we will also notify the relevant supervisory authorities.

11. Children's Privacy

AgentWake is not intended for use by anyone under the age of 18. We do not knowingly collect personal information from minors. If you believe a minor has purchased the Product, contact us and we will take appropriate steps.

12. Changes to This Policy

We may update this privacy policy from time to time. We will update the "Last updated" date at the top of this page when changes are made. Material changes will be communicated via the email address used at purchase.
